Independent Compliance Certification Body

Effective Date: [10.10.2022] ISA is an Independent Certification body, ISA issued compliance certificate according to self assessment, These Terms and Conditions ("Agreement") govern the provision of compliance certification services by [ISA Inspection & Certification], an independent certification body (hereafter referred to as the “ISA”), to any organization or individual seeking certification services.
Note:The Certification Body is not liable for any direct/indirect or consequential losses incurred by the client.
Total liability is limited to the amount of fees paid by the client for the specific certification service in question.

1. Scope of Services

The Certification Body provides independent third-party certification, auditing, inspection, and compliance assessment services for standards including but not limited to:
• ISO standards (e.g., ISO 9001, ISO 14001)
• Regulatory compliance assessments
• Environmental, health, and safety certifications
• Other agreed-upon standards

2. Application and Acceptance

By applying for certification, the Client agrees to:
• Provide accurate and complete information required for certification.
• Allow access to relevant premises, personnel, and documentation for audits.
• Abide by these Terms and Conditions throughout the certification cycle.

3. Obligations of the Client

The Client agrees to:
• Maintain the management system in accordance with the certified standard(s).
• Inform the Certification Body of any significant changes that may affect the certification (e.g., legal, structural, ownership, or operational changes). • Permit surveillance and re-certification audits as scheduled.
• Refrain from misusing or misrepresenting the certification status.

4. Certification Process

The Certification Body follows a standard process, which includes:
• Application review
• Stage 1 (Documentation Review) and Stage 2 (On-site Audit)
• Certification decision
• Ongoing surveillance audits
• Re-certification (typically every 3 years)
Issuance of certificates is at the sole discretion of the Certification Body, based on compliance with the relevant standard.

5. Fees and Payment

• All fees will be agreed upon in advance and are non-refundable once services commence.
• The Certification Body reserves the right to suspend or withdraw certification due to non-payment.

6. Confidentiality

The Certification Body will treat all information obtained in the course of certification activities as confidential, except where disclosure is required by law or with the Client’s written consent.

7. Use of Certification Mark and Certificate

• The Client may use the certification mark and certificate only in accordance with the Certification Body’s rules.
• Misuse of certification marks may result in suspension or withdrawal of certification.

8. Suspension and Withdrawal of Certification

Certification may be suspended or withdrawn if:
• The Client fails to comply with these Terms.
• There is evidence of non-compliance with the certified standard.
• Required audits are not conducted in the prescribed time frame.
• Fees are not paid.

9. Liability and Indemnity

• The Certification Body shall not be liable for any damages arising from the use or misuse of a certificate.
• The Client shall indemnify the Certification Body against claims arising from its operations or reliance on the certification.

10. Appeals and Complaints

• Clients have the right to appeal certification decisions or lodge complaints.
• All appeals or complaints must be submitted in writing.
• A formal, impartial process will be followed in handling such cases.

11. Force Majeure

The Certification Body shall not be held responsible for any delay or failure in performance due to events beyond its reasonable control, including but not limited to acts of God, war, natural disasters, or government restrictions.

12. Governing Law and Jurisdiction

These Terms shall be governed by the laws of [UK]. Any disputes shall be subject to the exclusive jurisdiction of the courts of [United Kingdom (UK)].

13. Amendments

The Certification Body reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any changes.
